Kristen M. Frost


Kristen M. Frost is an experienced trial lawyer who brings determination, skill and success to individual and corporate clients facing a myriad of legal issues. She specializes in white collar and criminal antitrust matters and in general criminal defense in various jurisdictions. She has tried numerous complex cases as lead counsel in federal court, throughout Colorado and in Illinois and Virginia.

Kristen passionately fights for the accused at all times, notwithstanding the nature of the accusations, the location of the prosecution team, or the difficulty of a case.

Her advocacy is not defined by successful jury verdicts alone. It involves high level strategy and hard fought battles to secure dismissal of cases before charges are filed and by way of litigation and complex motions practice after indictment.

Kristen has obtained the dismissal of charges in several high profile cases. She led the RMW team that secured the dismissal of an indictment charging a wide-ranging conspiracy to fix prices and rig bids for broiler chicken products brought by the Department of Justice Antitrust Division. After extensive litigation, the Court issued an order which effectively rendered much of the government’s evidence inadmissible based on a finding that the government had not sufficiently proved the existence of the charged conspiracy.

For almost 20 years, Kristen has represented clients during all aspects of a case, from pre-trial representation during the investigation phase, after indictment, at trial, during post-conviction proceedings and on appeal. She has argued before the United States Court of Appeals for the Seventh Circuit, the Colorado Court of Appeals, the Illinois Appellate Court and the Illinois Prisoner Review Board. She has defended professionals before the Colorado Department of Regulatory Agencies and the Colorado Supreme Court Attorney Regulation Counsel. She has handled complex international extradition issues and represented American citizens detained abroad facing extenuating circumstances.

Kristen is a member of the Criminal Justice Act Panel and is currently the Chair of the CJA Standing Committee. She is a frequent lecturer on various legal topics, including federal constitutional issues and federal motions and trial practice, white collar and antitrust issues, trial advocacy, and international criminal law. She has been a panelist at various conferences, including the American Bar Association Antitrust International Cartel Workshop, the Cambridge Forum White Collar Conference, the Lightfoot Annual White Collar Institute, and the NACDL White Collar Conference. She has lectured for the Criminal Justice Act Panel, the Colorado Criminal Defense Bar Association, the Colorado State Public Defenders. She has taught at the University of Colorado, the University of Denver and the Siracusa Institute.

Before joining RMW, Kristen was a defense attorney in Chicago and then became a Colorado Deputy State Public Defender. After law school, Kristen completed a post-graduate fellowship in international criminal law and human rights law at the Siracusa Institute in Italy, working with Professor M. Cherif Bassiouni. As a fellow, she worked on post-conflict justice and accountability projects involving Afghanistan and Iraq, drafted reports for the United Nations and other non-governmental organizations, and participated in local legal initiatives sponsored by the region of Sicily and the Italian government.

  • Secured dismissal of all charges for executive charged in a criminal antitrust matter that alleged an industry wide conspiracy to fix prices and rig bids in the broiler chicken industry.

  • Trial counsel to individual charged with federal securities fraud and wire fraud and trial counsel to individual charged with federal tax offenses.

  • Counsel to oil and gas corporation under federal investigation for various white collar offenses. The United State’s Attorney’s Office declined prosecution.

  • Trial counsel to doctor falsely accused of committing sexual assault on a patient. Client was swiftly acquitted after a prolonged jury trial. See Law Week article regarding the acquittal.

  • Trial counsel to federal agent indicted in the Northern District of Illinois for civil rights violations and witness tampering. Case was dismissed a week before trial after extensive pre-trial litigation based on prosecutorial misconduct, due process violations and interference with defense access to witnesses and evidence.

  • Counsel to a real estate broker indicted by the Attorney General of Colorado in a multi-defendant case involving various types of mortgage fraud. Case dismissed by prosecution before trial after substantial litigation and advocacy. 

  • Trial counsel to United States Air Force veteran falsely accused of sexual assault in a complicated case with accusations spanning twenty-five years and three different states. Client was quickly acquitted after two prolonged trials in two states.

  • Counsel to an American citizen detained in Germany based on criminal charges out of Colorado, involving extensive briefing of international extradition law and all applicable defenses to Colorado charges. Client returned home and the charges were eventually dismissed.

  • Counsel to individual charged with gaming and gambling offenses, involving significant novel litigation which resulted in the eventual dismissal of the charges.

  • Appellate and post-conviction counsel to individual convicted of first-degree murder in Chicago in a case involving extensive briefing before the United States District Court for the District of Northern Illinois, the Illinois Appellate Court and the Circuit Court of Cook County.

  • Counsel to accountant under federal investigation for various types of tax, mail and wire fraud, false claims and immigration violations related to employment law. The United State’s Attorney’s Office declined prosecution.

  • Trial counsel to a medical student accused of a sex offense who was quickly acquitted by the jury. 

  • Appellate counsel to hedge fund manager convicted of federal fraud. Briefed and argued case involving the interpretation and application of the United States Sentencing Guidelines before the United States Court of Appeals for the Seventh Circuit. 

  • Representation of foreign national detained in Germany based on a federal indictment out of the United States District Court in Colorado for allegations of pharmaceutical fraud requiring significant briefing of federal sentencing issues and defenses to extradition before the High Court in Munich, Germany. 

  • Counsel to pharmaceutical executive under federal investigation in Chicago for allegations of health care fraud. The United States Attorney’s Office declined prosecution. 

  • Trial counsel to Air Force Academy student falsely accused of domestic violence crimes and assault. Client was acquitted of all charges in less than an hour.

  • Representation of American student in London under investigation for possession and distribution of illicit materials, involving working with counsel in the United Kingdom. No charges were filed.

  • Appellate counsel for plaintiffs who brought suit against a large public health foundation seeking to unwind a $1.45 billion transaction. Extensively briefed case on appeal and argued before the Colorado Court of Appeals. Denver Business Journal

  • Trial counsel to several individuals charged in Chicago with first-degree murder who were acquitted by a jury. 

  • Counsel to dentist under investigation by the Attorney General of Colorado for various types of fraud and improper billing practices. The Attorney General’s Office declined prosecution. 

  • Trial counsel to individual charged with careless driving resulting in the death of two people who was quickly acquitted of those counts by a jury in Denver.

  • Counsel to church leader under investigation for sexual assault of church member. Charges were not filed by the District Attorney’s Office.

  • Counsel to numerous individuals charged with narcotics offenses in state and federal court who were either acquitted by a jury or where evidence was successfully suppressed after pre-trial litigation involving Fourth Amendment challenges.

  • Trial counsel to retired engineer charged in Colorado with assaulting an at-risk adult. Client was acquitted by a jury.

  • Representation of students at various universities accused of wrongdoing and defending against Title IX proceedings.

  • Trial counsel to juvenile charged with felony menacing who was found not guilty after trial.
